Terms of Purchase
WATCHMASTER (Schweiz) AG
Version: 1.0
Effective from: 1 October 2026
1. What these terms cover
1.1 These terms apply when you sell your watch to us or consign it to us for sale on commission. Your contracting party is WATCHMASTER (Schweiz) AG, Münchwilerstrasse 1, 9546 Tuttwil, Switzerland, UID CHE-499.857.879 (“we”). For the purchase of your watch, you can reach us at contact@watchmaster.com.
1.2 For every purchase we conclude a written contract, either as a purchase contract or as a consignment contract. What is agreed there takes precedence over these terms.
1.3 Purchases in our shop are governed by our General Terms and Conditions, not by these terms.
2. Who can sell
2.1 You can sell as a private individual from the age of 18 if you are the owner of the watch.
2.2 We buy watches with a market value of at least CHF 3’000. We do not exclude any brand as a matter of principle. However, we must see a realistic prospect of a sale.
2.3 We buy primarily from sellers in Switzerland and Liechtenstein. For other countries, we assess each case individually, because customs and import play a major role there. We do not buy from persons resident in a sanctioned country.
2.4 We may require an identity document and proof of the watch’s provenance. Without them, no contract is concluded.
3. How it works
3.1 Request. You describe your watch in the “Offer your watch” form and, if you like, send up to three photos. We only need photos of the papers once you accept our offer.
3.2 Initial offer. We get back to you with a free, non-binding initial offer, as a direct purchase, as a consignment or as both. It is based on your details and is not binding on either party.
3.3 Handover. If you accept the initial offer, we organise and pay for insured collection from you and send you instructions for packing. From the handover to our courier, the watch is insured until it arrives with us.
3.4 Inspection. Our watchmakers inspect authenticity, condition and function. We check the provenance, among other things, in databases of stolen and lost watches.
3.5 Binding offer. We then make you a binding offer with a deadline for acceptance. It may differ from the initial offer, for example if the watch does not match your details or needs a service. We will tell you the reason.
3.6 Contract. If you accept, we sign the contract. If you decline or we decide not to buy, we return the watch to you insured. You bear the cost of the return shipment. You incur no other costs.
4. Direct purchase
4.1 With a direct purchase, we buy your watch at a fixed price. It is lower than the possible proceeds of a consignment, because we bear the financing costs, the stock risk and the service.
4.2 We pay the purchase price within 15 working days of signing the contract.
4.3 Ownership of the watch passes to us upon full payment.
5. Consignment
5.1 With a consignment, we sell your watch on your behalf. In the consignment contract we agree a minimum selling price. We only sell below it at your express written request.
5.2 Commission. It is 20% for watches with a value of up to CHF 30’000. For watches above this value and for collections, we agree it individually.
5.3 Sales period. It lasts 365 days. Until the sale, you remain the owner of the watch. We store and ship it insured. We cannot guarantee a sale.
5.4 Service. If the watch needs a service, we tell you the cost in advance, and we only carry it out with your consent. The cost is borne by you and is set off against the proceeds. We charge no other fees.
5.5 Payout. The buyer has 10 days to return a watch with a defect or discrepancy (section 7 of the General Terms and Conditions). After this period has expired, we pay you the selling price within 15 working days, less commission and agreed service costs.
5.6 Reclaiming the watch. You can reclaim the watch as long as it has not been sold.
a) During the sales period, we invoice you for our costs of collection, inspection, reconditioning and marketing, in the amount of the commission on the agreed selling price.
b) After the sales period has ended, you do not incur these costs.
6. What you warrant to us
6.1 In the contract, you warrant to us that:
a) The watch belongs to you and you may freely dispose of it. It is not pledged, not leased and not financed, and nobody else has any rights in it.
b) The watch has not been reported stolen or lost.
c) The watch, its serial number, box and papers are genuine. You have disclosed spare parts not made by the manufacturer and modifications to the watch.
d) Your details about the watch are correct and complete. You have not concealed anything that matters for the purchase.
e) Customs duties and taxes on the watch have been paid.
6.2 If any of these warranties is not true, we may withdraw from the contract and reclaim anything already paid. You may have to compensate us for further damage.
7. Suspected theft or counterfeit
If the inspection shows that a watch may be stolen, reported lost or counterfeit, we may retain it and inform the police. The law may also oblige us to do so. As long as the authority requires it, we make no payment and do not return the watch. We will inform you as far as the authority allows.
8. Papers and personal details
Papers and box bearing your name, such as a warranty card, pass to the buyer when the watch is sold. You agree to this. How we handle your data is set out in our Privacy Policy, section 11 “Requests to sell your watch”.
9. Payment
9.1 We pay in Swiss francs by bank transfer, in a single payment and only to you, not to third parties. You are responsible for the correct bank details. Fees charged by a bank outside Switzerland are borne by you.
9.2 We may set off anything you owe us under the contract, such as service costs, against our payment.
10. Selling from abroad
If you send the watch from a country outside Switzerland, you take care of the export. Customs duties, taxes and fees incurred in the process are borne by you. For special materials such as gemstones or exotic leather, additional declarations may be required.
11. Liability
11.1 As long as the watch is in our care, it is insured.
11.2 To the extent permitted by law, our liability is limited to the amount of the offer we last made to you, i.e. the initial offer or the binding offer.
12. Law and place of jurisdiction
12.1 Swiss law applies. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
12.2 The place of jurisdiction is Tuttwil, Canton of Thurgau. As a consumer, you may also bring an action at your place of residence.
13. Final provisions
13.1 The version in force on the day of your request applies to the purchase of your watch. Later versions apply only if you agree to them.
13.2 If any provision is invalid, the remaining provisions remain valid.
13.3 These terms are available in German and English. In the event of discrepancies, the German version prevails.
